Fraudulent Tax Refund Claims and Its Consequences

Every year, many fauji family members are lured by local tax filing agents who promise high tax refunds by under reporting or not reporting the income. Unfortunately, these too-good-to-be-true promises can have severe repercussions.

In response to this growing concern, the AG branch issued an advisory in April this year, cautioning armed forces personnel about suspicious income tax refund claims. These claims often fall under various sections of the Income Tax Act, leading to significant penalties. (Read Advisory)

I will not get caught as there are so many tax filers

The underlying technology and processes used by the Income Tax Department have significantly improved over the years. With advancements in data analytics and automation, the identification of underreporting and misreporting of income has become much easier and more efficient. Modern systems can cross-verify financial transactions and flag inconsistencies, making it increasingly difficult for individuals to evade taxes unnoticed. 

Therefore, relying on the sheer volume of tax filers as a shield against detection is a risky and misguided approach.

Ok, what will happen if I get caught? 

When it is confirmed by the assessing officer that there is an under-reporting or mis-reporting of income, and a penalty under Section 270A of the Income Tax Act is imposed, the penalty provisions are as follows:

  • On under-reporting of income: The penalty imposed is equal to 50% of the tax due on the under-reported income.
  • On misreporting income: The penalty shall be equal to 200% of the tax due on the misreported income.

Fauji Family must note that the penalty imposed under Section 270A will be in addition to the tax due on under-reported or misreported income. The penalty for misreporting earnings (200%) is applied when an assess deliberately gives false or misleading information.

So my local agent is also liable for punishment? 

When you receive notices about fraudulent refunds, the local agents who helped are not liable for punishment. The entire responsibility falls on the fauji family members involved. It's crucial for fauji families to ensure all transactions and claims are legitimate to avoid legal issues.

Yes, it's crucial for armed forces personnel to be vigilant and ensure that their tax returns are accurate and compliant with the law. Falling for the allure of high refunds can lead to substantial financial and legal consequences.

It is crucial to file your Income Tax Return (ITR) with an authorised agent who holds an ERI (e-Return Intermediary) license issued by the Income Tax Department. These licensed agents are legally certified to assist taxpayers in filing their returns, ensuring accuracy and compliance with tax regulations.
